[OSM-legal-talk] Use of OSM in closed commercial software / License / Copyright?

Hello,

Firstly, I apologize if this question has been answered before, but
we're new to the world of Open Street Map.

Task:
I'm asking this question on behalf of our company. We're developing a
small add-on scenery for a 3D desktop simulation application X-plane.
For the process of developing our add-on scenery we would like to use
some of the data available in OSM. If it would be necessary, we would
also like to modify the data available from OSM, but only for the
purpose of our project, and no modification of OSM data will be publicly
available for further redistribution. The customer is an end client.
That means that the customer will not modify or reproduce the OSM data,
but the data from OSM will only help creating a more realistic scenery
of the simulated 3D world.

Questions:
1. Is this allowed to do under the OSM licence / Open Database License?
2. What do we have to include in our project in regards to Legal /
Copyright / Licensing?
3. Where do we provide credit to OpenStreetMap and what do we have to
write in the copyright notice? - Would it be fine to include such notice
in the "About file"?

Thank you for answering and sorry for a possible repetition.

Best regards,
Stelan
