<p>If somebody who was at that time on the board actually created the "OpenStreetMap" organisation, or if you could at least make clear that this was work done "for hire" clearly you can set the policies for inclusion of projects under the umbrella (outside of that it is simply somebody misusing the trademark). </p>

<p>You would however need to find an arrangement with projects that were included before such policies were made, and you couldn't actually stop projects from leaving.</p>

<p>The downside is naturally that somebody might infer liability of the OSMF if something goes wrong in a wide sense of the word with a project included in the org. </p>
