1) They just included that generic notice without thinking too much about it.<br>
2) They had to include it to be able to show a Google map.<br>

Either way, the wording applies to the 'site'. So, please ask them to clarify their position with respect to their data. If they're willing to open up their data, doing it as a separate download, not on the map, is best. It avoids all traces of Google involvement.<br>
