acknowledges that the PRODUCT delivered by PROVIDER is for the use only by
RECIPIENT and only for this PROJECT, and is not to be released in any form or
re-distributed to any other party without the <span class="yshortcuts" id="lw_1219277227_2">prior written consent</span> of
PROVIDER. RECIPIENT shall not share PRODUCT with other parties in violation of
any licenses, proprietary ownership, data sharing agreement or the <span class="yshortcuts" id="lw_1219277227_3">California
Public Records</span> Act (Government Code, Chapter 3.5, Sections 6250-6270). No
provision of the agreement shall limit the application of the <span class="yshortcuts" id="lw_1219277227_4">California Public
Records Act</span> or the <span style="border-bottom: medium none; background: transparent none repeat scroll 0% 0%; cursor: pointer; -moz-background-clip: -moz-initial; -moz-background-origin: -moz-initial; -moz-background-inline-policy: -moz-initial;" class="yshortcuts" id="lw_1219277227_5">Federal Freedom of Information Act</span> (5 United States
Code, Section 522). RECIPIENT may retain copies of the PRODUCT, including
copies stored on magnetic media, for information and reference in connection
with RECIPIENT˘S use for the PROJECT.</span></p><p class="MsoBodyText" style="margin-top: 5pt; text-align: justify;"><br><span style="font-size: 11.5pt;"></span></p>Attachment "A" would be a description of OpenStreetMap .... hmmm .... the fact that there's any talk of a license makes me wonder. But - if it Attachment "A" describes OSM (i.e. - make this data available via a Creative Commons license) - is that okay? Some of this reads like "This contract says you must not violate the terms of the contract!" - with really spelling out those terms. Attachment A, would effectively say "we want to give it away for free, in vector form!"<br><br> I think I'd mostly like use their data as a reference - not directly import the vector data through software, but when I see a missing street or feature, and don't have an opportunity to visit it, to compare. (This is particular true of streets in apartment complexes and mobile home
courts). I can easily place a "ref" tag to attribute the source. The only time I've heard of cities being protective of their data is for housing parcel data (which, for its purpose, is the most accurate data around).<br><br>Am I getting into territory I don't want to be in? RECIPIENT hereby agrees to assume any and all responsibility for any results
obtained in the use of this PRODUCT. RECIPIENT understands that the conversion
of data from one system, format, and projection to an alternate system, format,
or projection cannot be accomplished without the possibility of the
introduction of inexactitudes, anomalies, and errors. RECIPIENT agrees to assume
all risks associated therewith, and to the fullest extent permitted by law, to
hold harmless and to indemnify PROVIDER from and against all claims,
liabilities, losses, damages, and costs, including, but not limited to,
attorneys˘ fees, arising therefrom, or in connection therewith. The parties to
this agreement acknowledge that the PRODUCT is complex, and may contain some
nonconformity, defects or errors. The PROVIDER does not warrant that the
PRODUCT will meet the RECIPIENTS˘ needs or expectations, or that all

also strongly recommended that careful attention be paid to the contents of the
