Michael,
I don't understand why OSM cares in anyway about trade marks. Can you
explain?

We do want a clear statement from Position Technologies that they have the
rights to publish the data and that the data is being provided to us in a
suitable license, eg. CC0. But requiring them to provide their Data
Agreements, seems to be a bit of an overkill.
