I'd side with you on this issue. If someone makes available a WMS then 
he must accept that it is viewed by WMS clients. (JOSM should actually 
be enahnced to issue a GetCapabilities request and show licensing info 
to users but that's another thing.)

I think that there is a save to disk option if you right-click a WMS 
layer in the layer switcher but that is not tested very well.
