Distributing the linked code arguably is a violation of GPLv2, but it is 
not a violation of the Apache license, so the ASF cannot sue anyone over 
this, nor would they want to. In fact, according to 
http://www.apache.org/licenses/GPL-compatibility.html they tried to get 
the FSF to accept the Apache license as GPLv2 compatible.
