OSM is at fault in this instance.  The api publishes the data in the
form of an xml file.   But this file does not include the appropriate
CC-BY-SA license details nor does it provide any form of attribution.

Officially the API is in voilation of the license under which data has
been provided by contributors to OSM.  I think it would be a positive
step if we were to set our own house in order.
