AIUI Yahoo buy a package of rights, and the rights to sublicense said  
rights, from the imagery providers.

One of these rights is the derivation right. Yahoo are sublicensing  
that right to OSM.

This is very much AIUI though: Steve or Mikel will have more. Of  
course, it's a moot point whether any copyright subsists in tracings  
from anyone's aerial photos, anyway. I sorely doubt that it would in  
the States, for example.
