I agree with that. The problem is that we can find any number of
useful solutions but they might never be really watertight; there will
always be a slim and tiny chance of someone taking us (or someone
using our maps) to court for violation of the license.

If we can get the legal requirements out of our way by a simple but
useless mechanism, then we have all the freedom in the world to apply
our brains to finding an useful mechanism - even if only 90% of the
community agree to the useful one.
