Since it is PD, TIGER would be available regardless of OSM's licence.

The companies that have donated (in part) because of CC would not have  
made their data available regardless. So this doesn't compare.

If OSM can happily ignore what some people might regard as its moral  
obligation to be PD because of TIGER then this just underlines the  
weakness of PD.
