No, you can release that under whatever license to OSMÂ and as you still retain Copyright can do with it under whatever license you want (even most restrictive proprietary ones). 

This is why MySQL can release a GPL version and still sell you a proprietary licensed MySQL data base.

You just need to do it based on your own data and can't use OSM data to fill your gaps.
