The interesting point is that this behaviour exactly applies to a jpg-file that is derived from the database and which is doubtlessly classified as Produced Work: with every update of the osm-data you can create a new jpg-file and it always remains a Produced Work.

I see only two points that characterize the jpg-file as special: you cannot disasseble it and you cannot trace back to osm database elements automatically.
