[OSM-legal-talk] Does routing based on OSM data lead to a derived or assembled work?

Dear OSM enthusiasts,

I'd like to develop an advanced ROUTING application based on OSM data.
The user shall be able to draw ROUTES along available vectors and those
ROUTES shall be stored in a seperate database.

For display in web I'd like to render OSM data for the base layer and
put ROUTES on a different layer on top.

As far as I understood earlier postings this means:

- "OSM content remains unmodified"
- "points are taken from OSM as base for routing and to create another 
layer that contains routes"
- "layers are not combined descructively"

What es beeing created by the user or routing engine is a personal 
route, that he
or she wants to store in a database.

Is the database containing all user's personal routes to be put under 
CC-BY?

How will change of licence will affect this scenario?

I kindly thank you for any assistance in this matter.

BTW: Is there a way to search the whole legal archive at once?
