Hello,
There have been recent discussions in the talk-it mailing list
regarding the CC-BY-3.0 **IT** license.
Despite its name, it is quite different from "unported" CC-BY 3.0 license
because it has been adapted to the Italian jurisdiction and it has specific
parts regarding *sui generis right*.

The Creative Commons Italian chapter, who drafted this license, states:
*Rinuncia al diritto sui generis sulle banche dati: In Europa le licenze CC
devono confrontarsi con il cosiddetto diritto “sui generis” sulle banche
dati. Quest’ultimo, a differenza del diritto d’autore, finisce per
proteggere il contenuto dei database e per questa ragione si tratta di una
norma insidiosa, specie in ambiti come la ricerca scientifica. Creative
Commons Science ha sottolineato come l’esistenza di tale diritto su opere
scientifiche contenenti banche dati e rilasciate sotto licenza CC
rischiasse di vanificare completamente le finalità della licenza stessa in
ambito europeo. Le licenze CC 3.0 europee sono dunque caratterizzate dalla
completa rinuncia a far valere il diritto sui generis sulle banche dati:
resta comunque tutelato il diritto d’autore per quel che riguarda la
struttura della banca dati, assieme ad altre caratteristiche “espressive”
della stessa. Ma è garantito il libero utilizzo dei fatti e delle
informazioni contenute nella banca dati.*

(Translation: Waiver of the sui generis right on databases: In Europe, CC
licenses have to deal with the so-called "sui generis" right on databases.
The latter, unlike copyright, ends up protecting the content of databases
and for this reason it is an insidious rule, especially in areas such as
scientific research. Creative Commons Science pointed out that the
existence of this right on scientific works containing databases and
released under a CC license risked to completely nullify the purposes of
the license itself in the European context. The European CC 3.0 licenses
are therefore characterized by the complete waiver of the sui generis right
on the databases: the copyright is still protected with regard to the
structure of the database, together with other "expressive" characteristics
of the same. But the free use of the facts and information contained in the
database is guaranteed.")
In particular, closely examining the License, at the end of article 3, you
can read:
*"Qualora l'Opera concessa in licenza includa una o più banche dati sulle
quali il Licenziante è titolare di un diritto sui generis ai sensi delle
norme nazionali di attuazione della Direttiva 96/9/CE sulle banche dati, il
Licenziante rinuncia a far valere il diritto corrispondente."*
*(*Translation: "If the Licensed Work includes one or more databases on
which the Licensor holds a sui generis right under the national laws
implementing Directive 96/9/EC on databases, the Licensor waives the
corresponding right.")
Moreover, in paragraph 3.c, it is stated:
*"Al fine di evitare dubbi, è inteso che le restrizioni di cui ai
precedenti punti 4.a e 4.b non si applicano a quelle parti dell'opera che
siano da considerarsi Opera ai sensi della presente Licenza solo in quanto
protette dal diritto sui generis su banca dati ai sensi delle norme
nazionali di attuazione della Direttiva 96/9/CE sulle banche dati."*
*(*Translation: To avoid any doubt, the restrictions listed in paragraphs
4.a and 4.b do not apply to those parts of the work that are to be
considered Work under this License only because they are protected by sui
generis right on a database in accordance with the national laws
implementing the Directive 96/9/EC on databases.")
Paragraphs 4.a and 4.b a talk, among other things, about distribution and
attribution.
Therefore this License specify that the Licensor waives the sui generis
right on the database (i.e. it is de facto in the Public Domain) and
moreover it also specify - to avoid any doubt - that the Licensee has no
obligation regarding distribution and attribution.
It is my understanding that datasets distributed under this License are
suitable to be imported in OSM and a specific waiver is not required
because, not only there is no attribution requirement, but there isn't any
restriction applied to databases.
Please also note that similar paragraphs are included in all CC 3.0 IT
licenses such as CC-BY-SA 3.0 IT and other European CC 3.0 "ported"
licences as analysed in https://www.ivir.nl/publicaties//download/299.pdf.
Thus, if the Licensor distribute a database with one of these licences, it
waives its rights altogether.
