If you map the buildings you can use the building=yes tag as well --
they'll then render as buildings. The mapnik renderer at least (and
I'm fairly sure the t at h one too) will render the smaller areas on top
of the larger area.

Yes, technically layer tags are to indicate real physical vertical
separation, ie: a road going over another road, and not to tell the
renderer what order to put things in. So a land use area should never
normally have a layer tag (there are exceptions such as underground
car parks etc).
