There is no (written) agreement that I'm aware of. However, OSM knows 
about ESRI and ESRI knows about OSM.

In particular, ESRI is going to put OSM as an option on the new flex map 
builder thingamajic - I knew about this some 6 months ago. I can ask 
some Spanish ESRI devs to clarify, if needed.


I don't think the issue of tile server load is too important - AFAIK, 
ESRI web map apps aren't that popular.
