The usual way (or at least the way that I have often seen) is that board 
can decide (which includes that board can also delegate the decision 
e.g. to another body if they want) but the decision has to be based on 
the policy. So the policy might e.g. say that people can be thrown out 
for "behaviour suitable to tarnish the reputation of OSMF", but whether 
what you do actually is suitable etc.etc. is subject to a decision made 
by human beings.

The plan is that we write down what we want, in non-legal terms, and 
then have that converted into suitable legalese by a professional.
