I'd say : The attribution guidelines should require whatever &Contributors see fit, and OSMF should support that!   :-)

Law and legal actions are not the only scope of mind of contributors. Notably, I personally enjoy the simple shaming that the attribution requirement authorizes in this thread and elsewhere.
I do want the Contributors attributed when OSM data is displayed, and every pressure to do so is welcome. No need no court for that, don't you think?
