TomTom appears to be doing exactly what
https://wiki.osmfoundation.org/wiki/Organised_Editing_Guidelines asks
of it.
While it would not be unreasonable to ask them about the provenance of
their data, TomTom is certainly capable of entering their own data
from their own proprietary database into OSM. They don't need a
license agreement *with themselves*.
