We believe that the Law on e-Government is explicit and that it takes precedence over lesser documents (such as website terms of service) that do not carry the same legal weight.

Regardless, the section of the portal TOS you're referring to ("приликом свакe поновнe употрeбe" / "upon each re-use") requires the user of the OD portal to provide attribution each time he/she reuses the data he/she downloaded from the portal. It says nothing about or relates to downstream/secondary usage. If the legislature had intended to regulate downstream/secondary reuse, it would have been explicitly stated in the legislation.

The following passage from the Rationale (Образложење) for the proposed changes to the Law on Administrative Taxes of 2022, which changed the regime for access to the Address Registry from paid to open data, demonstrates that the broadest possible reuse of the Address Registry data was the spirit of the law and the intention of the legislature.

Успостављањем нове инфраструктуре дистрибуције и успостављања дигиталних процеса ажурирања, ова такса је постала безначајна и препрека за масовно коришћење адресног регистра. У току 2021. године само 6 правних лица је платило таксу за њихово коришћење у вредности од 1.129.884,00 динара. Чињење бесплатним адресни регистар доћиће до његовог масовног коришћења и развоја привреде и пословања нарочито у делу услуга и саобраћаја код такси услуга, логистике приликом оптимизације рута за доставу и вожњу, курирских служби и многих других грана привреде.

According to the Law on Republic Geodetic Fees, access to the Address Register's codebook was free, while access to geometry was charged by the RGZ [Republic Geodetic Authority]. With the establishment of a new distribution infrastructure and the digitization of data update procedures, this fee has become insignificant and an impediment to the Address Register's widespread use. In 2021, only 6 legal entities paid this fee totaling RSD 1,129,884.00. Making the Address Register available for free will result in its widespread use and growth of the economy and business, particularly in the services sector and transportation services for taxis, logistics when optimizing routes for delivery and driving, courier services, and many other sectors of the economy.
