When creating relations, ways by single contributors often get split. One part is assigned to the splitter, the other part is assigned to the original creator. If these mappers have expressed different opinions about the license change, splits are a perfect cause for a legal conflict.

Split ways (with old nodes) are a perfect target for lawsuits as both the splitter and the former creator (whose nodes remain) can claim a moral right on this way. I know some (big) mappers who would like to sue OSMF just for pride - in order to prove how stupid the license change is. 

If we are excluding 15,000 small non-responding mappers for legal reasons, we cannot ignore the legal threat by authors who are picking some splits in order to contest the license change.

Right. Provided that you have assigned the moral rights to an author who deserves it. That's why I have suggested to consider the creator of the second-oldest node as author. 

Currently, the database still contains a lot of hijacked ways (100% of nodes are from A, but B is considered as creator). However, assigning a lawful intellectual property to one of two authors (e.g. the decliner) requires more careful research - either by the LWG or by the court that cares for a hijacked / split way case.
