AFAIK it has already been solved in recent versions of JOSM: the
current stable always downloads relations, and splitting a way that
belongs to a relation usually does the right thing, depending on the
relation, at least for multipoligons and turn restrictions.

anyway, this is an example of a problem that can (and will) be solved
with better support for relations in the editors, not a problem
intrinsic in the data model.
