and it is not quite enough. Layer without something like covered, 
tunnel, bridge is meaningless according to wiki.

covered=yes on the lower way would solve it formally. Layer=-1
could be applied to the lower way and would look a bit strange.

The layer on the upper way may not work well because covered & layer
should be on the same object. Tools would probably ignore the layer
tag in this case which would not cause any actual breakage but
imho redundant tags should be avoided.

It would not hurt to invent a new tag for natural overhangs?
