1) The note was already there, but it was worded in a confusing way
(it was stated in an indirect way with "The OSM use does not limit the
size of such home").

2) I agree that it is a problem (I started this discussion because I was
affected by this confusion), but at least in this case difference in
meaning is not massive

3) So how orphanages should be tagged within social_facility scheme?
