That is a great understatement.
Two examples:
• An equalization of object identities between regional mappers and a regional road authority that provides its data under the condition "commercial use only with special permission, any transfer to other persons prohibited"
• A long lasting and well establlished co-operation: A local database with several thousands of objects actively announces each actualization to local mappers who map each new object, at once, but also look in the database. Condition as published in the impressum of the database portal , "copies, publlications or recording in databases as well as any commercial use and the transfer to other persons is not permitted".

Of course, there is no danger for OSM.
And any commercial exploiter simply has to leave those kinds of information out of his own products, on which he is not sure that commercial use is permitted. That is a matter of his renderer.
