I agree with Martin, leave that to authorities.  Stay neutral and objective.
Similar, do we tag buildings that are erected without a building permit ?
Do we tag land encroachers ?
Shops operating without a trading license ?
Abusers of human rights ?
etc.. etc...

Some of the data we provide can be used by authorities to make their 
conclusions, and maybe it would be good practice to mark these in the 
wiki (like we do for military bases / mapping in China) as it can cause 
harm to mappers or to map users, but it is not up to any of an 
individual to mark these opinions.  Most of us are not specialists in 
specific legislation, in case of discrepancy let the judiciary do it's work.
