Just to be clear: A cycleway is a road, and a carriageway is a road.

So what you're asking is: when there is a carriageway with a parallel 
cycleway, are pedestrians compelled to use the carriageway's shoulder 
instead of the cycleway?

They must use either road's shoulder when they can instead of using 
either road's "way" (carriageway or cycleway), so if the choice 
hypothecially was only between the carriageway's shoulder and the 
cycleway, and the cycleway's shoulder for some reason was not a choice, 
the carriageway's shoulder is what the law says they must choose.

For cycleway with sidewalk, the sidewalk is almost never mapped 
separately. If it is mapped separately, foot=use_sidepath make sense. 
But these cycleways are not the primary issue, since they would be 
tagged with sidewalk/segregated/use_sidewalk, and so are at least 
recognisable for what they are. The primary issue is how to tag a 
cycleway that does not have a sidewalk at all.

How would I propose such a preset? It would be very useful.
