The DCS Spatial Services waiver we obtained at

specified "Spatial Web Services" which at the time covered

   3. NSW Points of Interest
   4. NSW Administrative Boundaries
   5. NSW Imagery Date
   6. NSW Address Location Service
   7. NSW Cadastre
   8. NSW Property
   9. NSW Topographic Map
   10. NSW Survey Control Management System (SCIMS)

However now that page lists more datasets as "Web Services"
https://www.spatial.nsw.gov.au/products_and_services/web_services which now
does include
https://portal.spatial.nsw.gov.au/portal/home/item.html?id=85ca688f5e9c43e28363dda4bbf23d42
which is the NSW Elevation and Depth Theme data from ELVIS.

Based on this I'm comfortable that we can use this data under the existing
waiver we have.

What I'd suggest is to document your process for deriving the stream
geometry from the ELVIS data and what you're proposing to import and how.
eg. how do you determine how far upstream to map, how do you determine if
what's in OSM is better already than ELVIS or if ELVIS is better.
