Legal documents that are 'public' are free to use FOR PRIVATE PURPOSES
only. There is an intention to change this, as a business legally may
not use the contents of a 'public' document for something that has to do
with their business (might be considered commercial use as a business
always is 'commercial'...).
Somewhere i found that this limitation does not exist for 'environmental
data or documents'.... (milieuinformatie) 'milieuinformatie' is
completely free to use.
A problem seems to be that official instances often use copyrighted
material (like topo-maps) as a background layer to add their info on top
(like 'gewestplannen' and RUP) without mentioning the copyright notice
for the base-map, although legally they should when they publish it or
hand over a copy.
In this case the plans seem to be based on data from 'kadaster'. Normaly
you can get a copy from the kadaster if you need it, but you have to pay
for it, and may not copy it again... This probably *SHOULD* be mentioned
on the published RUP maps, but they don't or they forgot.
Note that in general copyright does not have to be mentioned on a
publication to exist. But in this case (publieke bestuursdocumenten -
milieuinformatie ) the law says that if copyright exists on (part of)
the data it should be mentioned when it is published.
Don't have the legal text here at hand. perhaps someone else has.
