I also fail to see any issue with what they are doing. If they violate
the tile usage policy, they will get the "access blocked" message
instead of maps. If they would not be aware of the policy now (I don't
know, just speculating), they will be at that moment. And then it's
their call how they handle it.
Let the people managing the servers decide what is acceptable use and
what is overuse and block users if needed. No need for us to jump in
every time someone shows an OSM map on his website.
