You don't get that information when you download only a way from the 
API, right?

Today's lesson is: Always download where you want to edit. In this case, 
download where you want to split a way. You'll get all the relations for 
that way, and the split will produce the correct results.

The conflict detection and resolving stuff in JOSM has been quite wonky 
in one way or another over the past year, but recently it's been quite 
good, in my experience at least. Current tested is 2561, latest is way 
past that. Hopefully a lot of the old cruft will go once they release a 
new tested version shortly.
