I'm not sure; isn't the access tag for the way rather than the gate?
And access=private on a way does not imply it's completely inaccessible,
just that it is a 'private road' which you may or may not be allowed to
drive down.

Again, would you tag foot=yes on the gate itself? And why not car=no?

That makes some sense, but according to the wiki 'access=yes' means an
official, legally-enshrined right of way, which is not necessarily the case here.
