OGL, but haven't yet confirmed that they don't contain third-party
rights that ONS aren't authorised to licence. The latter would be
excluded from the OGL-licenced content, so we should wait for
confirmation here before making use of the data.

Some correspondence has been added to the page linked by Robert, dated 19 August. If I read it correctly, the ONS has provided all the confirmations that Robert was looking for.
