In my opinion we should be always mapping access restrictions as they 
are seen on the ground (signs, gates). If the legal status is known and 
its meaning is clear (e.g. PROW) we should use a different set of tags 
to avoid confusion.

Most title deeds come with restrictive covenants, often very specific, 
like exclusion of certain type of traffic or a traffic with a certain 
purpose. Reality on the ground is often very different, for example I've 
seen many residential areas where private roads are designed in a way to 
encourage transit foot/cycle traffic.
