That's a tricky case.  They've explicitly declined using the license
terms on the site, but also made a PD declaration somewhere else.  I
don't know the details of the user you are discussing.  Would they
consider transferring the account to you, to accept the terms?

There is also the adoption route, which has implementation issues to
