   However we're not offering the data for sale....


    But the most sure method is if you can convince them to change their 
license in the Arcgis open data portal to "Open Data Commons" / PDDL.

   PS if anyone knows how to access that setting, could you take some 
screenshots of the procedure and post it somewhere?
