Yeah, agreed. There's lots I could say about this but as Erik says,  
these discussions tend to be offputting, boring and frustrating in  
equal measure for everyone except us copyright geeks.

+1 vote for an osm-legal list.

(FWIW, I agree with the general consensus that, under UK law at least,  
OSM work is copyrightable - just like any commercially available  
geodata. The GPS tracks may not be... but I don't see that as a  
problem.)
