Sounds like Bridgeman v Corel :

To be on the safe side, you should scan the printed map. But they have
a dubious copyright claim on their scanning unless they've
substantially added new content. If they've merely scanned it then
there's been no new creativity, and hence nothing to copyright.

Having said that, if they're anything like the british OS they'll try
to claim copyright on anything under the sun.

There's no such thing as intellectual property rights. (Perhaps they
mean database rights? http://en.wikipedia.org/wiki/Database_rights - a
totally absurd piece of law.)
