The person who uploads the gpx wouldnt nesseserly be the person speeding.   
Someone may have given you the gps data to upload on there behalf.  (as Andy 
said)

Also, the govenment arnt paranoid, there just money hurders.  They couldnt 
give a dam really.

The evedience couldnt be used in court I imagin, as its digital, and there 
is no prove that the data wasnt edited, to give higher speeds that what you 
were doing.

I axcidently strolled over someones lawn the other day, so i disided to 
remove that data, rather than have it private.  As its private to the land 
owner, Its not just a matter of me not wanting to have my name on it.  
(slighty off the point, but trespacing is another crime that can be seen in 
a gpx file)

p.s.  I got 42mph on my push bike in a 30mph the other day, yey!  I could 
argue that I threw my gps down the hill in front of me, and then picked it 
up at the bottom.
