I agree. With the CC licence as applied to an artwork, it's fairly clear 
what a derivative is. But when applied to data, it certainly seems a lot 
greyer. How much of the data can you use and in what way before it 
becomes a derivative work?

On the www.geograph.org.uk site we allow users to create cc-by-sa works 
comprising a photograph and geolocation metadata. If you were to do some 
fact extraction on such a work, you could perhaps build up a dataset of 
say, locations of churches. Does the extraction of a church name and 
approximate coordinate constitute a derivative work? Is that really an 
artistic expression or IP that can protected by copyright law?
