Apart from fair dealing (may be called fair use in your jurisdiction) 
and the derivation of a fact, the definitions disappear in to case law. 
Or worse, case law about one jurisdiction made in another, viz Corel.

Essentially this is coming down to the age-old BSD vs. GPL debate and 
it's pretty clear there are strong opinions on both sides, but spreading 
FUD about data being unusable isn't going to get us anywhere. By this I 
mean on the one hand stating IANAL and then making sweeping legal 
judgments. :-)

If someone wants to be constructive then they can help nick with the 
legal panel at the conference, take this to one of the various CC groups 
for help and get back to us. Something like the cartography day but 
focusing on the license issue could be organised also.
