I don't think anyone does. Hence it's near impossible to ensure you
don't step over it - which is why the "large majority of OSM mappers"
continue to "err on the safe side" :P

I'm not sure it works at all :P You probably want to follow up on
http://lists.openstreetmap.org/listinfo/legal-talk if you want to get
into the nitty-gritty. Search and read the archives first though -
this isn't the first time this has come up.
