Probably in most jurisdictions the intent will come into the equation.
If I make a random change in OSM data just for laughs, then it will be
hard to make a case against me, but if I change a road to lead over a
cliff, knowing full well that my enemy #1 is going to download the data
into his satnav that night and then blindly trust it then I might be
facing trouble, no matter whether OSM had a big red "this is all just
for laughs" message when you sign on or not.
