The PD check box is purely advisory, see

Note that the CTs guarantee that required attribution will survive any
future licence changes (or data with such requirements would have to be
removed) so the likelihood of a switch to PD actually happening is
negligible. Despite the amount of FUD that continues to be generated on
exactly this point.
