The data has finally been released officially by the Bundesregierung
(Federal Government) with the "GeoNutzV, Verordnung zur Festlegung der
Nutzungsbestimmungen für die Bereitstellung von Geodaten des Bundes"
(http://www.geodatenzentrum.de/docpdf/geonutzv.pdf).

The problem should be solved.
