How about the following?

1) Set the JOSM default to Mercator, because this produces the best 
results at high zoom levels, which is the common case;

2) If you attempt to download WMS imagery from an EPSG-only WMS server 
above a certain zoom level, and you are using Mercator, pop up a warning 
saying that you need to switch to EPSG if you want the imagery to be 
correct.

I agree that there's a danger of bad mapping without the warning - but 
currently, people are getting fuzzy WMS imagery in the common case, 
because Mercator imagery from e.g. NPEmaps or Yahoo is being distorted 
to fit EPSG.
