This discussion pops up all the time. There are good reasons to put
multiple ways on the same nodes, and also good reasons not to. JOSM will
not take sides in this debate.
(As for borders: If a certain road or river represents a border, as far
as I am concerned it should simply become a member of the respective
relation; I wouldn't create a second way that uses the same nodes in
this case.)

This could probably be done - do these cases not show up in the JOSM
validator plugin?
