[OSM-legal-talk] Licensing Scenario - not theoretical

I'm currently "employed" (the money might go to me, or direct to OSM I
haven't decided yet) in creating a set of tiles from some scans of out
of copyright OS maps. I need to geolocate at least one of the maps. I
can do this using ways in the OSM rendered tiles.
1. Is this a derived work?
2. Is it still a derived work if I only use ways that I personally
created in OSM.
I'm pretty damn sure they're going to be mine because
a) they don't yet exist in OSM
b) no-one else has yet done any work in the area in question.
c) I'll be geolocating within minutes of the data going up/tiles being
rendered.
I can't be definitively sure unless I ask someone to do a database
search on edits in the area within a certain timeframe.
Under case 2 If I assume I "own" the copyright on the nodes/segments/ways.
Who owns the copyright on the rendered tiles?
In practice I personally would like to waive my copyright on stuff
(make it PD/whatever) I add to OSM, though I can't see any option to
do this.
