I agree - could you add something about that "dissident test" on the 
Wiki page that Peter has initiated: 
http://wiki.openstreetmap.org/index.php/Open_Data_License

It currently reads:

"For the avoidance of doubt: the use of a work by a small and exclusive 
number of customers should be deemed to be public and triggers this 
clause to release any Derived Database"

And I have added a yellow-ish "this is under discussion" note to it.
